Actually, according to DMCA law, he is allowed to make 1 (ONE) backup of his software, which means law takes precedence over EULA. all he is requesting is a BACKUP of his software. I would say, if he can take a picture of the diskette, you should be able to send him an image, because not only does it not violate the DMCA, but it proves he owns it, therefore it's not piracy.
