No, you see, the first picture with capsules is "Before", and the "After" image is the more generic non capsul menu.

In OS X can menus even be like the rounded rectangle (capsule is like an aqua button) in the first mockup?

I say keep the old menus and then for the rest, go with your new & improved mockup. I really like the original menus.

A little too similar to Takashi Izawa's AlumiteX for my liking... Surely no one could ever make three true classics in a row. But this theme may still have a string in it's boot…

It's the same tone as Alumite, but looks glossier and a lot cleaner. Can't wait!
