The person that sues and looses should have to pay court costs and damages. That just might end a lot of frivolous lawsuits.

This actually happens often�the defendant will counter-sue for lawyers fees, lost income, and anything else they had to pay for in their defense. Additionally, not all cases get accepted in the first place, i.e. if you have a bad case most attorneys simply won't take it.
